1. Introduction

Welcome to Alletaa Works LLP. These Terms and Conditions ("Terms") govern your use of our delivery services provided under the names "Alletaa Delivery" and "Alletaa". By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services

Description of Services: Alletaa Works LLP provides delivery services for various goods. We facilitate the ordering, payment, and delivery process through our website and mobile application.

Eligibility: You must be at least 18 years old to use our services. By using our services, you represent and warrant that you meet this age requirement.

3. Orders

Placing Orders: When you place an order, you agree to provide accurate and complete information. You are responsible for ensuring that the information you provide is current and correct.

Order Confirmation: Upon receiving your order, we will send you a confirmation email. This confirmation does not constitute acceptance of your order but is an acknowledgment that we have received it.

Order Acceptance: We reserve the right to accept or reject any order for any reason, including product availability, errors in the description or price of the product, or any other issue.

4. Payments

Payment Methods: We accept various payment methods, including credit cards, debit cards, and other electronic payment systems. By providing payment information, you represent and warrant that you are authorized to use the chosen payment method.

Payment Processing: Payment is processed at the time of order placement. If the payment method fails, we reserve the right to cancel your order.

Pricing: All prices are listed in the applicable currency and are subject to change without notice. Taxes and delivery charges are additional and will be indicated at the time of order placement.

5. Delivery

Delivery Times: Delivery times are estimates and may vary due to factors beyond our control. We will make reasonable efforts to deliver your order within the estimated timeframe.

Delivery Address: You are responsible for providing a correct and complete delivery address. We are not responsible for orders delivered to an incorrect address provided by you.

Delivery Issues: If there are any issues with your delivery, please contact us immediately. We will work to resolve the issue as quickly as possible.

No Delivery Partners: If there are no delivery partners available in your area, we may cancel your order. We will notify you promptly if this situation arises.

Address and Location Sharing: If your address is not saved in our system, you are required to provide your current address and location when booking a delivery. A rider will not be dispatched until this information is provided.

6. Shipping Policy

Shipping Methods: We offer various shipping methods to meet your needs. The available shipping options will be presented to you at checkout.

Shipping Charges: Shipping charges are calculated based on the delivery location, shipping method selected, and the weight and dimensions of the items. These charges will be displayed at checkout. On average, a shipping charge of 50 rupees is applied per delivery.

Order Tracking: Once your order has been shipped, we will provide you with a tracking number so you can monitor the status of your delivery.

Delivery Time: As we are an on-demand delivery company, most orders are delivered within an hour. However, in certain circumstances, delivery may take up to one day.

7. Payment Terms

Merchant Payment Options: Merchants using Alletaa Works LLP's delivery services have the option to collect payments directly from customers. If the merchant chooses this option, they are responsible for paying the delivery charges to Alletaa Works LLP on a weekly basis. The merchant assumes full responsibility for collecting payments from customers.

Payment Collection Service: Alternatively, merchants may opt for Alletaa Works LLP to collect payments from customers on their behalf. In this case, Alletaa Works LLP will be responsible for collecting payments and will handle all related obligations.

Gateway Charge: When collecting payments on behalf of merchants, Alletaa Works LLP will deduct a gateway charge of 2% of the total collected amount. This charge covers transaction processing fees and administrative costs associated with the payment collection service.

Delivery Charge Deduction: The delivery charge incurred for the service will also be deducted from the total amount collected.

Tax and Other Charges: Additionally, applicable taxes (such as 18% GST on the gateway charge) and any other relevant charges will be deducted as per the agreement between Alletaa Works LLP and the merchant.

Payment Remittance: Alletaa Works LLP will remit the remaining amount to the merchant on a weekly basis, every Thursday. The remittance will include the total amount collected from customers minus the delivery charge, gateway charge, taxes, and other applicable charges.

8. Cancellations, Returns, and Refunds

Order Cancellations: You may cancel your order within a specified timeframe, provided that the order has not been processed or shipped. Please contact us to cancel your order.

Return Policy: We do not accept returns. All sales are final. As a delivery company, we only act as a middleman between the merchant and the customer. Any return requests must be handled directly between the customer and the merchant.

Return Process: As we do not accept returns, there is no return process. Please ensure that your order is correct before finalizing your purchase

Refund Policy: If the merchant accepts a refund request from the customer, we will process the refund within 3 working days from the time of the merchant's approval. Refunds will be issued to the original payment method. Please note that it may take additional time for your bank or credit card company to process and post the refund to your account.

9. Payment Responsibility and Consequences

If Alletaa Works LLP takes responsibility for collecting payments on behalf of the customer from the merchant, the following conditions apply:

Payment Attempts: Alletaa Works LLP will make reasonable efforts to send payment requests to the customer. If the customer fails to make payment after the first attempt, Alletaa Works LLP may send a second payment request.
Penalty for Non-Payment: In the event that payment is not made after the second attempt, the customer may be liable to pay double the amount of the original order as a penalty. Legal action may also be pursued to recover the outstanding amount.
Impact on Merchant Payment: Delay in payment to the merchant may occur if payment collection from the customer is unsuccessful or delayed due to non-payment.

It is the customer's responsibility to ensure timely payment for orders where Alletaa Works LLP is collecting payment on their behalf. Failure to comply may result in penalties and legal consequences as outlined above.

10. Use of Services

Prohibited Activities: You agree not to engage in any activity that interferes with or disrupts our services, including but not limited to hacking, spamming, or transmitting any harmful code.

Account Security: You are responsible for maintaining the confidentiality of your account information and password. You agree to notify us immediately of any unauthorized use of your account.

11. Document Delivery and Liability for Missing Products

Non-Delivery of Original Documents: Alletaa Works LLP does not deliver original documents such as government-issued IDs, passports, legal contracts, or other important original papers. Only photocopies (e.g., Xerox copies) are allowed for delivery. Any order requesting the delivery of original documents will be rejected.
Liability for Missing Products: Alletaa Works LLP is not liable for any missing products or items during delivery. While we strive to ensure that your items are delivered safely, it is the customer’s responsibility to ensure that the correct items are handed over at the time of delivery. We recommend that both senders and receivers inspect the package upon handover. Alletaa Works LLP will not be held responsible for any claims of missing items once the delivery is completed.

12. Limitation of Responsibility Post-Delivery

Once an order is successfully delivered to the customer at the provided delivery address, Alletaa Works LLP shall not be responsible for any subsequent handling, use, or condition of the delivered items. Any issues arising after delivery, including but not limited to product defects, quality concerns, or damages, are the sole responsibility of the customer. It is recommended that customers promptly inspect delivered items upon receipt and contact Alletaa Works LLP immediately in case of any issues.

Inspection: Customers are advised to inspect delivered items promptly upon receipt to ensure satisfaction and report any concerns promptly.

13. Waiting Time Charges

If the delivery rider reaches the store or the specified location and the waiting time exceeds the predefined waiting period, additional charges may apply.

Predefined Waiting Period: The standard waiting period for a delivery rider at a store or specified location is 5 minutes.
Additional Charges: If the rider's waiting time exceeds the predefined period, a charge of ₹1.5 per minute will be applied for each additional minute.
Billing: These additional waiting time charges will be added to the total delivery cost and must be paid by the customer at the time of payment.

14. Intellectual Property

Ownership: All content, trademarks, and other intellectual property used in our services are owned by or licensed to Alletaa Works LLP. You agree not to use any intellectual property without our prior written consent.

Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes, subject to these Terms.

15. Data Misuse

Merchant Data Responsibility: Merchants are strictly prohibited from misusing customer data, including but not limited to addresses, contact details, and payment information. Any misuse of customer data will result in severe penalties, including fines and potential legal action. Alletaa Works LLP reserves the right to take any necessary measures to protect customer data and ensure compliance with data protection regulations.

16. Limitation of Liability

No Warranty: Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free from viruses or other harmful components.

Limitation of Liability: To the fullest extent permitted by law, Alletaa Works LLP and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our services.

17. Indemnification

You agree to indemnify, defend, and hold harmless Alletaa Works LLP and its affiliates, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of our services, or your violation of these Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in [Your City], India.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our website and updating the effective date.
